These rules govern the raffle and are binding on every ticket buyer and person named in a ticket for DesertArc's (DA) Palm Springs Dream Home Raffle.

WHO CAN BUY RAFFLE TICKETS:

Ticket buyers and everyone named on a ticket must be at least 18 years old at the time of purchase. Tickets can be bought only in the names of people (not corporations, businesses or other entities). A ticket can be bought in the name of 1, 2, or 3 persons. If more than 3 persons are named on an entry form, then only the first 3 names (as determined by DA) are eligible. DA employees and board members can buy tickets but cannot be named on a ticket as a potential prize winner with the following exception: DA employees and Board members are eligible to be a prize winner for the Refer A Friend Drawing but only as a referring person.

RAFFLE PURCHASE DEADLINES:

The raffle may sell out before a deadline. Tickets purchased by a deadline qualify for all future drawings. Deadlines may be extended at DA's discretion without notice.

RAFFLE DRAWING DATES, TIMES, AND LOCATION:

(Please check website for updates.) Location of drawings will be published on the official raffle website, and everyone is welcome. Winners need not be present. Tickets cost $100 each, and for a limited time 3 tickets purchased at the same time in the same names cost only $275, 6 tickets purchased at the same time in the same names cost only $525 and 10 tickets purchased at the same time in the same names cost only $850.

DA may add other purchase discounts and promotions during the raffle without notice.

Tickets can be bought by cash (in person only), credit card or check or money order payable to DA. Confirmation of ticket purchases will be sent to the first person named on each entry form. People named on a ticket do not need to possess a ticket or a purchase confirmation in order to win.

Entry forms deemed by DA to be defective, illegible or submitted without good funds will not be honored. DA assumes no responsibility for anyone's failure to timely buy tickets or for notifying anyone who attempts to buy a ticket with a defective or illegible entry form or without good funds. All sales are final. No changes to the people named on an entry form or ticket will be made after the purchase. No payments will be refunded, including payments received from ineligible parties, except at DA'S discretion. All applicable federal, state, and local laws, regulations, and ordinances apply to this raffle. This raffle is void where prohibited by law.

THE DRAWINGS:

DA will randomly draw the winning tickets at each drawing. The odds of winning prizes depend on the number of tickets in each drawing and the number of tickets you buy. If 22,000 tickets are sold, then the odds of any 1 ticket winning the Grand Prize will be 1 in 22,000.

At each drawing, the first ticket drawn will be for that drawing's least valuable prize and the last ticket drawn will be for that drawing's most valuable prize. No ticket can win more than 1 prize in each drawing (except Grand Prize Drawing). Refer-A-Friend Drawing: For every person who purchases a ticket and refers an individual who purchases a ticket or tickets, one entry shall be entered into the $5,000 Refer-A-Friend Drawing. First Prize shall be $5,000. If multiple individuals refer the same person who purchases a ticket or tickets, the earliest referral and corresponding purchase of tickets shall take precedent. For each referred individual who purchases a ticket or tickets there shall be one entry into the Refer-A-Friend Drawing for each ticket purchased by the referred party.

Multi-Ticket Drawing: Only for buyers of more than 1 ticket during the raffle. Buy 2 tickets in the same name(s) and, in addition to those tickets being entered in all other eligible drawings, you receive 1 entry in the Multi-Ticket Drawing, buy 3 tickets in the same names and you receive 2 entries in the Multi-Ticket Drawing, etc.

Mega Ticket Drawing:  Purchase 6 or more tickets AT THE SAME TIME for a chance at $5,000!

Refer a Friend and Get a Free Ticket: When you refer a friend who buys a ticket and names you as the person who referred them, you receive a free ticket. There’s no limit. Applies only to referrals made on or after April 29, 2010. You must buy or already have bought a ticket to be eligible.

Half Price Tickets: Buy a ticket for $100, and you may buy a second ticket for $50. Offer applies to 3- 6 and 10-packs of tickets, too! Applies only to tickets bought on or after April 29, 2010.

Mega Winner 50-50 Split Cash Drawing: Buy 100 tickets for $5,000. Entries are limited to 20 people. The winner receives an amount equal to half the total amount paid into this promotion. For example, if 12 people enter, the total amount paid into the promotion would be $60,000, the winner would receive $30,000, and his chances would be 1 in 12 of winning. All tickets remain eligible for all other prize drawings.

Winning tickets in all early drawings will be re-entered in the raffle for all subsequent drawings. It is possible for 1 ticket to win 1 prize in each Early Bird Drawing as well as the Grand Prize.

Drawing dates may be extended at DA's discretion without notice. Lists of the winners of each drawing will be posted at www.palmspringsdreamhomeraffle.com.

MAXIMUM AND MINIMUM TICKETS:

A maximum of 22,000 tickets will be sold. In the event that If at least 20,000 tickets have not been sold by the final deadline, then all prizes will be awarded except the Grand Prize will not be the home or $500,000 but instead will be 50% of "net raffle proceeds", defined as the balance of ticket sales revenue remaining after payment of all other prizes (whether or not claimed or awarded) and all raffle-related expenses as determined by DA, which shall be final and binding.

RULES APPLICABLE TO ALL TICKET BUYERS AND ALL PRIZE WINNERS:

DA will make reasonable efforts to contact prize winners using the information on the winning entry form. If a prize winner cannot be located within 30 days after the drawing or if any person is ineligible under these Rules or applicable law, then he/she will not be awarded the prize, no other ticket will be substituted for that ticket and the prize will be retained by DA. Any prize not claimed within 60 days after that prize's drawing will not be awarded. A person named on a ticket cannot transfer his/her interest in the ticket.

Each winner is solely responsible for timely paying and reporting all taxes attributable to that winner's prizes, whether or not DA withholds taxes or complies with withholding laws. Each winner authorizes DA to withhold and/or collect from that winner all required amounts.

As a condition to receiving a prize, each winner shall deliver to DA: (1) a signed/sworn affidavit of eligibility under these Rules and applicable law; (2) any information required by applicable law, including Social Security Number; (3) proof of identity and age; and (4) a publicity release allowing the winner's name, likeness, voice and city of residence to be recorded by DA by audio, video, or digital means and to be used by DA in any print, audio or visual media without notice or compensation. Each person who buys a ticket and/or whose name appears on a ticket: (1) agrees that DA, its directors, officers, employees, agents, representatives and the home seller/donor are not responsible for any injuries, losses or damages of any kind arising in connection with, or as a result of this raffle and/or that person's failure to win or redeem any prize, or that person's award of, acceptance of or use of, any prize; and (2) releases and agrees to indemnify, defend, protect, and hold harmless DA and the home seller/donor and their officers, directors, shareholders, employees, agents, advertising agency, contractors, insurers, attorneys, accountants and affiliates from and against all losses, damages, rights, claims and actions of any kind arising in connection with this raffle, that person's failure to win or redeem any prize, that person's tax liabilities with respect to that person's prizes, and that person's award of, acceptance of, or use of any prize; and (3) represents and warrants to DA that he/she has read and understands these Rules and agrees to be bound by these Rules and DA'S decisions as to the raffle, which are final.

Each prize and its related tax liability belongs 100% to 1 person named on a ticket, 50% to each of 2 persons named on a ticket, and 33-1/3% to each of 3 persons named on a ticket.

Under IRS rules, amounts paid for tickets are not tax-deductible except to the extent allowed as gambling losses.

All prizes are subject to availability at time of Drawings and prize selection. If a prize is not available DA will make all reasonable efforts to offer a similar substitute or a cash alternative.

RULES APPLICABLE TO THE GRAND PRIZE WINNER:

If the Grand Prize winner is eligible under these Rules to select the home, then the Grand Prize winner can elect to receive the home instead of the alternate cash prize only by delivering written notice to DA within 45 days after the Grand Prize drawing. To be effective this notice must be signed by everyone named on the winning ticket. If DA does not receive this notice within that period, then the Grand Prize winner is deemed to have irrevocably elected not to receive the home and to receive the alternate cash prize. If the Grand Prize winner elects to receive the home, but does not deliver in a timely manner to DA the required withholding amounts or such other items necessary to complete the transfer of the home to the winner, as determined in DA'S discretion, then DA may award the alternate cash prize instead of the home. The recipient of the home shall accept it through an escrow, without furnishings, in AS-IS, WHERE-IS condition and DA and the home transferor have no liability relating to the home. DA and the home transferor give no guarantee, agreement, representation or warranty, express or implied, in connection with the home, including as to its value or that it can be sold for any certain price or within any certain period. The Grand Prize winner acknowledges that government authorities may place a different value on the home than DA or the home transferor placed on the home in determining any income, property, transfer, or other taxes or fees that may be attributable to the home. If the home is subject to a lease, then the Grand Prize winner shall either allow a reasonable time for the lease to be terminated and the tenant to vacate the home or accept the home subject to that lease. If the Grand Prize winner elects to receive the home, then the winner shall sign and deliver a purchase contract and related escrow instructions within 7 days after these documents are provided, reasonably cooperate in the escrow process, promptly sign and deliver documents customary for acquiring residential real estate, and cause escrow to close within 45 days after it opens. The Grand Prize winner is solely responsible for timely paying all escrow and title insurance charges, homeowner association dues and assessments, transfer taxes and all other charges imposed in connection with the home and its transfer. DA and the home transferor may substitute the home for a home of reasonably equivalent value.
